  • Sam ships most items within two weeks, but always on Fridays unless otherwise specified (It will say “SHIPPING TIME UPDATE” in the product description. Fridays are just when my postal worker does their pickup.)

  • Due to the nature of the clothing, Sam does not accept returns or exchanges. If the product is damaged due to shipping, please file a report with the postal service and I can help you navigate that. Please be sure to read the descriptions of all products before purchasing to verify if it is a physical or digital product.

    If something happens to the item due to improper care, fault of the buyer, Sam will not refund/return the item. Under special circumstances will Sam be able to recreate a custom design, but that is never guaranteed because each item will be slightly different due to it being handmade.

    There is no refunds/returns for digital products at all.

    This Privacy Policy explains how Sam Bartley Designs ("we," "us," or "our") collects, uses, shares, and protects personal information when you visit https://sambartleydesigns.com (the "Site"), buy our products, subscribe to our emails, or otherwise interact with us (together, the "Services").

    1. Summary

    • We collect the information you give us (such as name, email, and shipping details) and information collected automatically through cookies and similar technologies.

    • We use it to run the Site, fulfill orders, respond to you, send marketing you have asked for, measure Site performance, and (with your consent where required) show relevant ads.

    • We use Google and Pinterest tools that may collect information about your visit. See Section 5.

    • We do not sell your information for money. Some advertising uses may count as "sharing" or "sale" under certain U.S. state laws; you can opt out (Section 9).

    • We do not knowingly collect information from children.

    • You can exercise your privacy rights at any time (Section 10).

    2. Information We Collect

    Information you provide to us

    • Contact details: name, email address, phone number (if provided), billing and shipping address.

    • Order details: products purchased, order history, and communications about your order. Payment card details are entered directly with our payment processor and are not stored on our servers.

    • Messages and form submissions: what you send through contact forms, email, or social media.

    • Marketing preferences: newsletter subscription and communication choices.

    • Account details, if you create an account (username, password, saved addresses).

    Information collected automatically

    • Device and browser information: IP address, browser type, operating system, device identifiers, language, and screen size.

    • Usage information: pages viewed, links clicked, referring and exit pages, time on page, approximate location derived from IP address, and actions taken on the Site (such as adding items to a cart).

    • Cookie and similar-technology data (see Sections 4 and 5).

    Information from third parties We may receive limited information from our payment processors (such as order confirmation and fraud-screening results), from Google and Pinterest (aggregated analytics and ad-performance reports), and from you if you interact with us on Pinterest or other social platforms.

    Sensitive information. We do not intentionally collect sensitive personal information (such as government IDs, precise geolocation, health data, or biometric data). Please do not send us any.

    3. How We Use Your Information

    We use personal information to:

    • Provide, operate, and secure the Site and process and ship orders;

    • Process payments, prevent fraud, and keep records as required by tax and accounting law;

    • Respond to inquiries and provide customer support;

    • Send order-related and service messages;

    • Send marketing emails and product news (you can unsubscribe at any time);

    • Understand how the Site is used and improve our products, content, and design;

    • Measure and, where permitted, personalize advertising on Google, Pinterest, and other platforms;

    • Comply with legal obligations and enforce our terms; and

    • Protect the rights, property, or safety of our customers, the public, or ourselves.

    Legal bases (EEA, UK, and Switzerland)

    Where the GDPR or UK GDPR applies, we rely on:

    • Contract: to process and deliver your orders;

    • Consent: for marketing emails and for non-essential cookies, advertising, and analytics technologies. You can withdraw consent at any time without affecting earlier processing;

    • Legitimate interests: to secure the Site, prevent fraud, and understand and improve the Services, where these interests are not overridden by your rights;

    • Legal obligation: for tax, accounting, and other legal requirements.

    Canada

    We rely on your express or implied consent, or on another legal exception where the law allows.

    4. Cookies and Similar Technologies

    We and our partners use cookies, pixels, tags, local storage, and similar technologies to:

    • Operate the Site (essential cookies for cart, checkout, login, and security);

    • Remember preferences;

    • Analyze traffic and performance; and

    • Measure and personalize advertising.

    Your choices. In the EEA, UK, and Switzerland, we ask for your consent through a cookie banner before setting non-essential cookies. Elsewhere, you can manage preferences through the cookie banner or "Cookie Settings" link on the Site (if available) and through your browser settings. Blocking some cookies may affect how the Site works. You can also use the opt-out tools in Section 9.

    5. Google and Pinterest

    Google

    We use Google services, which may include Google Analytics, Google Ads / conversion tracking, Google Merchant Center (product listings), and Google Maps Platform (maps and address features) [DELETE ANY YOU DO NOT USE]. These services may use cookies and similar technologies to collect information about your use of the Site (including your IP address and pages visited) and share it with Google.

    For visitors in the EEA, UK, and Switzerland, we obtain consent before using advertising and analytics cookies, and we share consent choices with Google as its EU User Consent Policy requires. Where we use Google Maps Platform, you are also bound by the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

    Pinterest

    We use Pinterest tools, which may include the Pinterest Tag (conversion and audience measurement), Save buttons/widgets, and Pinterest Business features [DELETE ANY YOU DO NOT USE]. These tools may collect information such as pages viewed, products viewed or purchased, and device and browser information, and may collect hashed email addresses if you provide them at checkout.

    • Pinterest uses this information to measure ad performance, build audiences, and show more relevant ads, in accordance with its own privacy policy: https://policy.pinterest.com/en/privacy-policy

    • We use the Pinterest Tag only in line with Pinterest's Advertising Services Agreement and Business terms, and we do not send Pinterest sensitive information or information about children.

    • If you use the Save button or interact with our content on Pinterest, Pinterest's own terms and privacy policy apply to that activity.

    • You can manage Pinterest ad personalization in your Pinterest account settings or through Pinterest's help center.

    We do not control how Google or Pinterest handle information they collect independently. Please review their policies.

    6. How We Share Personal Information

    We share information only as described below:

    • Service providers that help us operate, such as hosting and website platform providers (WordPress/WooCommerce), payment processors [INSERT: e.g., Stripe, PayPal, WooPayments], shipping carriers, email marketing providers [INSERT], analytics and advertising providers (Google, Pinterest), and customer support tools. They may use your information only to provide services to us under contract.

    • Advertising and analytics partners, through cookies and pixels described in Sections 4 and 5. Under some state laws, this may be considered "sharing" for cross-context behavioral advertising or "sale" (see Sections 9 and 10).

    • Legal and safety reasons: to comply with law, respond to lawful requests, enforce our terms, or protect rights, safety, and property.

    • Business transfers: in a merger, acquisition, financing, or sale of assets, your information may be transferred to the successor, who will honor this policy or notify you of changes.

    • With your consent or at your direction.

    We do not sell your personal information for money, and we do not knowingly sell or share the personal information of anyone under 16.

    7. Payments

    Payments are handled by our third-party payment processors through WooCommerce. We do not receive or store your full card number or security code. The processor's privacy policy governs its handling of your payment data. WooCommerce's privacy policy is at https://automattic.com/privacy/.

    8. Retention, Security, and International Transfers

    Retention. We keep personal information only as long as needed for the purposes described in this policy, including to meet legal, tax, accounting, or reporting requirements (for example, order records are generally kept for up to [7] years). When we no longer need it, we delete or anonymize it, or securely isolate it until deletion is possible (for example, in backups).

    Security. We use reasonable administrative, technical, and physical safeguards, including encryption in transit (HTTPS). No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

    International transfers. We are based in the United States, and your information may be processed there and in other countries where our providers operate. Where required, we use approved transfer safeguards such as the EU-U.S. Data Privacy Framework (where the recipient participates) or Standard Contractual Clauses.

    9. Your Choices

    • Marketing emails: click "unsubscribe" in any email or contact us. We may still send order and service messages.

    • Cookies: use our cookie banner/settings and your browser controls.

    • Interest-based advertising opt-outs:

    • Do Not Sell or Share My Personal Information (U.S. state residents): email sam@sambartley.com with the subject "Do Not Sell or Share" [or use the "Your Privacy Choices" link on the Site, if available].

    • Global Privacy Control (GPC) and Do Not Track: where required by law, we treat a recognized GPC signal as a request to opt out of the sale/sharing of personal information for that browser. We do not otherwise respond to Do Not Track signals because no uniform standard exists.

    10. Privacy Rights

    Depending on where you live, you may have some or all of these rights:

    • Access / know what personal information we hold about you and receive a copy (including in a portable format);

    • Correct inaccurate information;

    • Delete your personal information;

    • Restrict or object to certain processing, including processing for targeted advertising, sale, or profiling;

    • Opt out of sale, sharing, or targeted advertising;

    • Withdraw consent at any time;

    • Not be discriminated against for exercising your rights;

    • Appeal a decision if we decline your request; and

    • Lodge a complaint with your data protection authority.

We may need to verify your identity, and you may use an authorized agent (we may ask for proof of authorization). We will respond within the time required by law (generally 30 to 45 days, with a possible extension where permitted).

    Appeals: if we decline your request, you may appeal by replying to our decision or emailing sam@sambartley.com with "Appeal" in the subject line. We will respond in writing within the period required by law (generally 45 to 60 days). If your appeal is denied, you may contact your state Attorney General.

    United States

    We are a small business and may not meet the thresholds of every state privacy law, but we honor the rights described in this section for all U.S. residents to the extent practicable, including residents of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, and any other state with a comprehensive privacy law.

    Disclosed for a business purpose: identifiers, customer records, commercial information, and internet activity to service providers listed in Section 6.

    "Sold" or "shared" (as defined by California law): identifiers, internet activity, and commercial information (such as products viewed or purchased) with Google and Pinterest for advertising and analytics. You may opt out as described in Section 9.

    California "Shine the Light": California residents may request information about disclosures to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing.

    California minors: if you are under 18 and a California resident with a registered account, you may request removal of content you have publicly posted.

    European Economic Area, UK, and Switzerland

    You have the rights listed above under the GDPR/UK GDPR/Swiss FADP. You may complain to your local supervisory authority (for Switzerland: the Federal Data Protection and Information Commissioner). Providing personal information is voluntary, but we cannot process orders without the necessary details.

    Canada, Australia, New Zealand, and South Africa

    You may request access to or correction of your personal information by contacting us. You may complain to the Office of the Privacy Commissioner of Canada or your provincial authority; the Office of the Australian Information Commissioner; the New Zealand Office of the Privacy Commissioner; or, in South Africa, the Information Regulator (enquiries@inforegulator.org.za; complaints: POPIAComplaints@inforegulator.org.za).

    11. Children's Privacy

    The Services are not directed to children under 18, and we do not knowingly collect personal information from anyone under 18 (or under 16 in the EEA/UK where a lower age applies). If you believe a child has provided us personal information, contact sam@sambartley.com and we will delete it promptly.

    12. Third-Party Links

    The Site may link to other websites and services (including Pinterest and social media). We are not responsible for their content or privacy practices, and this policy does not apply to them.

    13. Email Marketing (CAN-SPAM and Similar Laws)

    Our marketing emails identify us as the sender, include our postal address, and contain a working unsubscribe link. We honor unsubscribe requests promptly (within 10 business days at most).

    14. Changes to This Policy

    We may update this policy from time to time. The "Last updated" date above shows when it was last revised. If we make material changes, we will post a notice on the Site or contact you where required. Please review this policy periodically.
